Unfortunately nothing has changed with Davison I'm not surprised because the only time they communicate is when your paying them.

However, I must respectfully disagree with your assertion that there is no basis for a refund. While I acknowledge the approvals provided throughout the design process, I do not believe these approvals or the services rendered justify the total cost of $8,815, nor do they reflect the expectations set by Davison Design and Development, Inc.The deliverables I received—such as the ideation sketches, virtual renderings, and executive briefing—are not proportionate to the substantial investment I made. Additionally, I was led to believe there would be far more involvement in the actual product development and commercialization process, which was not the case. I had no direct interaction with the businesses or corporations allegedly contacted on my behalf, nor was I given any significant updates beyond vague statements about the "reactive" status of the project.

This has been an ongoing issue since 2019.Furthermore, I was only informed about the supposed licensing issue in September 2024, despite this being a fundamental concern that should have been addressed much earlier. If licensing was a problem, why did Davison accept payment and proceed without mentioning it until several years later?While I did provide positive feedback during the process, this was based on promises and expectations that my product would be successfully developed and brought to market—none of which have come to fruition. I feel misled by the promises made and the lack of transparency throughout the process. Additionally, I now realize that many other customers have faced similar issues, as evidenced by multiple online reviews.Given the lack of meaningful results after nearly five years and the fact that the services rendered fall far short of the $8,815 charged, I believe there is indeed a valid basis for a refund.

There is no basis for a refund. All services have been completed with your express written approval and authorization. Further, you have provided positive feedback regarding these services. Any retrospective belief that “more should have been done” is purely speculative and provides no valid argument to support a refund from services rendered.Specifically, during the design process, you provided written approval of the Preliminary Ideation Sketch, written approval of the Preliminary Virtual Rendering, written approval of the Industrial Ideation Sketch and written approval of the Industrial Virtual Rendering.

After completion of the design, you were provided with an Executive Briefing. You completed a questionnaire about this Executive Briefing providing positive feedback and then you provided written authorization to proceed with the presentations of your product idea. The presentations were made according to the terms of the contract. To date, no corporation has expressed an interest in further reviewing or licensing your product idea.

The project is now in a ”reactive” stage where updates are provided only in the event a corporation contacts Davison to express interest in the product idea.These details were explained to you in the company’s response to your compliant on PissedConsumer.com and the “reactive” status of the project was explained to you in an email from Davison’s licensing department in May 2024. Dear Davison Business Owner,
My name is Michael Whitley, and I am writing to formally file a complaint against Davison Innovation. I am requesting a refund of at least 90% of the total amount I paid, which is $8,815.

My payments to Davison Innovation began in 2019, with the final payment submitted in 2022.
Throughout this period, I made numerous follow-up phone calls and sent several emails requesting updates on the progress of selling my idea. Unfortunately, these efforts have been met with little to no response, leaving me feeling hopeless and manipulated. The financial strain caused by the payments to Davison Innovation has been significant, adding considerable stress to my family. We had hoped to see a return on this investment, but instead, we have been left in a precarious situation.
Initially, Davison Innovation was highly supportive and communicative during the payment process.

However, once the final payment was made, I experienced considerable difficulty in contacting my assigned representative. This lack of communication became particularly challenging during the COVID-19 pandemic when jobs were being cut, and financial resources were depleted. My family and I had decided to pursue entrepreneurship, and it was during this time that I engaged with Davison Innovation.
Each interaction with your team felt rushed and insincere, with no meaningful updates provided. The $8,815 I paid could have gone towards essential expenses such as mortgage payments, bills, and food for my children.

I find it troubling that Davison Innovation would continue to accept payments without any intention or ability to bring my idea to fruition.
I communicated with Mat Alwine on several occasions, and his focus was entirely on ensuring payments were made. He claimed to have multiple leads, but there was no evidence to support this. He also mentioned that he had shared my product with various business owners, yet there was no documentation or proof provided. On one occasion, Mat informed me that the bottles needed for my product were broken, and he presented me with a booklet portfolio, which he said was meant to show business owners.

This felt like a scam, as there was no documentation of any actual reviews or interest in my product. Eventually, Mat left the company, and I was not informed of this change.
Lindsay Leda was then assigned to my case, but despite this, I received no phone calls or updates. I had to personally seek out information on who was handling my case. Since her assignment, Lindsay has been unresponsive and unhelpful, showing little to no knowledge of my case.
At this point, I am no longer willing to continue requesting updates or waiting for Davison Innovation to bring my idea to fruition.

I demand an immediate refund and am not interested in any further delays. Please consider this as my final request for a refund. If there are any questions regarding the payment methods, please contact me directly.

I will not tolerate any further deceit or manipulation from Davison Innovation.

I've received a call today from the licensing team member, Donald Cinkan, and he was very helpful. I asked him if I'd be able to get the prototype for presenting at tool showcasing shows personally, which he said I would be able to do but advised against me doing, due to the fact that companies may see my idea and tweak it. He then offered to have me talk to another department to talk about producing and shelving the tool through Davison itself, which I will look into and see what they have to say.

I'm not slandering the company or making accusations, nor am I yet to state my satisfactory with the company, I'm simply sharing my experience with them so far and where I'm currently at with them on my journey.

First off I'd like to state that I'm very confident in my idea. I know the idea does not exist and that it is an extremely useful tool within the construction field, and that it would revolutionize the digital level and it's usefulness.

I've worked the construction field for 6+ years and have never seen the tool on the field, nor have I ever found anything close to similar to it in my extensive searches for such a thing.

I called multiple companies and even a few patent attorneys before making my decision to go with Davison, I believe in 2021. I didn't state my idea on the website's application page, I wanted some sort of legal documentation before throwing my idea out to a company I didn't know. I was shortly after contacted by Mr. Gary Dufour, which is the reason I chose to share my idea and invest in this company, because he was very easy to talk with, understanding, and genuine.

Mr. Dufour mailed me the paperwork to sign off on, so I shared my idea with him, and he seemed to completely understand what the tool's use was, what it was needed for, and how handy it would be in the construction field. He kept in contact with me regularly, about once a month, and always replied nearly immediately if I ever was the one to try to contact him.

I don't remember the exact order of things but I was sent many papers to sign off on throughout the process, asked to make a sketch and description of my idea of the tool, and I paid a small fee for them to do a background check of other patents that existed that may be the same or similar to mine. We eventually began payments, which they gave me options, and the ability to pay in installments.

I ended up paying around $14,000 in a little over the course of a year, agreeing that I would take 80% of any of the royalties the tool made(if bought and sold by any companies), and Davison would take the other 20%.

After fully finishing my payments, which like I said took a bit over a year, they began the next stage of development, which I believe was the 3D modeling phase. They sent me emails with the models, allowed me to request any changes if I wanted, and then I signed off on them once I was satisfied with the rendering. They did a very good job at creating the model, to which they even sent me the blueprints of the products design. The next step was creating the prototype and packaging.

Things were moving and I was feeling hopeful. They sent me pictures of the prototype and packaging, which I felt great about. In my mind the Davison Invention company were miracle workers and I was ready for us to start making our earnings as a team together.

But there was another phase of filing for a provisional patent, which was another few hundred dollars(which understandably is needed for presenting to companies), then onto presenting MY IDEA TO THE BIG COMPANIES!

They kept me updated every month with a list of who they presented my idea to and also... how many companies picked up my idea.( 0 ) Eventually as time went on I was just told if anything changes then they'll contact me rather than the frequent monthly calls.

I started to lose faith in my idea, thinking maybe I overlooked something and the tool already exists. Why else would a big tool conglomerate like Klein turn down such a genius idea? I eventually figured I'd just forget about my "genius idea" and just move on with life.

The sad truth is that having an idea and trying to do your best at making something of it is a long, grueling and agonizing process of paranoia, anxiety and self-doubt. It feels like anyone could stab you in the back, it's scary, and for me it feels like everybody thinks you're naive and don't support you.

That's part of the reason I went with Davison, they make the whole roller coaster of a ride feel like it's on track and not just a complete car wreck. The problem is that you are actually in a car wreck the entire time, but they do such a good job at helping you believe in your idea that you think the car wreck is a roller coaster. And that's not their fault, you should believe in your idea, but this kind of stuff doesn't just happen. There's a lot of work that's put into it by this company that goes unseen, and it seems like people(including myself) just want them to snap their fingers and have their product sold.

The past few days I've been trying to get in contact with them because I know I can make this happen.

Mr. Dufour has answered my text message yesterday, but I have yet to get on the phone with anyone.

My current plan is to ask for the prototype so that I can take a road trip with a great friend I just met and bring it to some of these new tool showcase shows and start making him, Gary and myself the money that I know this tool will bring us. And hopefully I can come back and leave an updated success story to help give some hope to anyone that's taken a chance with their idea with the Davison company.

No feedback from Davison I'm waiting for them to explain to me why they treat good people this way that rely on them

I am shocked and disappointed by Davison's treatment, considering my ongoing financial investments. Despite losing my Fruit Punch BBQ sauce, I continued to collaborate in good faith.

However, their actions are unacceptable, hurtful, and reflect a disturbing pattern of exploitation. I request the immediate refund of $8,815.00.

Someone, please help me get closure from Davison. They ripped me off and broke my heart.

Inventionland Fraud /Davison

Michael Macel,a representative for Davison at Inventionland,are frauds.When I presented my idea to them,they tell you in phase1,after giving them 800.00,that your idea would be sketched,and patented,with a portfolio.Well I never received any of these things,and I received a portfolio of someone else's product.Then finally after a few phone calls,which I knew was leading up to more money,they asked for 5,000 dollars on a product that took only 20.00 to make.So now I can't continue with phase 2,and I lost 800.00,and my product is now hitting the stores,and nothing was done with my 800.00.Please do not ever give these people your money....Scam!!!!!!

Your post falsely claims the contract you entered was for a “sketch and patent” for your idea. To the contrary, the contract is a pre-development agreement for research services. Davison compiled this information which comprised US patent documents and information of products currently available which are similar to your submitted idea. The contract explicitly states; “Davison is not responsible for applying for or obtaining any intellectual property protections on the Product or Design, including but not limited to patents, trademarks and trade names.”

Your post falsely implies that you were not informed of additional services and fees before entering the contract. You first contacted Davison through its website. The system utilized for electronic submissions makes it impossible for a person to submit an idea without first having two separate disclosures displayed in a printable and savable format, and the person electronically acknowledging the disclosures. You acknowledged, via an electronic signature, that you received and read the two disclosure statements. It is important to note that the disclosures are made BEFORE you entered any service contract and BEFORE you made any payment. Among the disclosures is the statement that “It is Davison’s normal practice to seek more than one contract in connection with a submitted idea.” The disclosure then provides a listing the various services and related fees. As you are a resident of California, the fee disclosures are again provided within the pre-development contract. Also, the pre-development agreement states: “Client is responsible for obtaining a product sample and relevant information about the product in a professional format for presentation to a Licensee, at Client's sole expense. Davison, at its option, will offer to provide further development services, under a separate contract for a separate fee….” Finally, this information is freely available on the company’s website. Any allegation of a failure to disclose the additional services and fees is not valid.

Your post makes the thoroughly unsubstantiated claim that you were asked to pay $5000 for a $20 item. The contracts offered by Davison are SERVICE contracts, specifically services related to the design and development of product ideas. Your comment confuses the retail price of an item with the substantially different expense associated with the design and development of an idea into a product.

Finally, your comment that “my product is now hitting the stores” falsely implies some conduct by Davison and is unsubstantiated. Assuming “your product” is in fact currently selling; your comment is premised on two false assumptions. Initially, your comment is premised on the assumption that no other individual has ever thought of a product similar to your idea. As the pre-development research typically demonstrates, this is a false assumption. It is not uncommon for multiple people to have the same idea for a new product. To obtain some understanding of the “prior art” is the express purpose of the pre-development service. Second, as you first contacted Davison in October 2016 and filed this complaint three months later, your comment assumes that a concept can go from a pure idea to a product on store shelves in there months. This is not feasible. The time necessary to take an idea through research, design, development, manufacturing, packaging, and distribution is significantly more than three months.

As stated, you were fully informed of all services and their related fees offered by Davison, BEFORE entering into any contract. It is simply not possible to be more upfront with clients about the services and fees that are offered. The services for which there existed a contract have been performed. No additional contracts have been entered and no additional payments have been received. It is misleading for you to allege you were not informed of the various services and their related fees or to complain that no product was produced when you declined those services.

2012 ripped off for 9 thousand treated rude hung up on 9 times they did nothing they promised was put on a do not call list they lost my patent they told me to go to you know where and NEVER contact them again Stay away they will rip you off BIG TIME oyt ot 800 thousand onlyn16 people had their inventions processed to the end Carole from Fla excuse spelling I could sure use that 9 thousand NOW DO NOT GIVE THESE DISHONEST people one I am trying to get on every site I can an warn other people not to give them money so they wont lose everything like I did. Contrary to your posted comments, Davison performed its services with your express written approval and authorization. The services were completed by May 2013 and were performed to your documented satisfaction. You have chosen to ignore the signed approvals, authorizations and questionnaires indicating the services provided were professional and completed in accordance with the contract terms. Instead, you have chosen, in our opinion, to misuse the online complaint sites as a means to vent your frustrations. Regardless of how often you may post a complaint, the facts do not change. There is simply no factual support for your complaint.

You contacted Davison about a new product idea in 2012. You entered into an agreement for the completion of research relevant to your product idea. Following completion of the initial service, you completed a questionnaire in which you provided positive feedback. You then entered into an agreement for the design and construction of a product sample and the preparation of presentation materials. These services were completed with your express written approval. You authorized the presentation of your product idea. You also completed a second questionnaire in which you supplied positive feedback about the design and the presentation material. Unfortunately, the corporation to whom your idea was presented chose not to enter a license agreement. Davison offered additional services for additional presentations which you declined.

Despite having secured your approval and authorization in the development of your product idea, and despite your having completed questionnaires providing positive feedback, you have pursued a series of antagonistic complaints. Purely in the interest of customer satisfaction, Davison offered additional presentations at no cost to you. You declined that offer, preferring to pursue your baseless complaints.

For over 25 years, Davison has helped everyday people prepare and present their ideas to corporations, manufacturers, and retailers to see if they would be willing to license the product ideas. Our exclusive idea to product method is responsible for more products on the store shelves than any other competitor in this industry.

Did not receive services as proposed

Submitted Patented idea to Davison, in hopes of working with them for licensing product (hair accessory organizer case). Made it quite easy for them by sending design specs, picture of what it should look like.

After they were paid in full the flat fee $13+ after two months of constant calls, asking has anything been accomplished-they sent me picture of some *** looking case that did not even resemble my idea, wanting me to sign off on it! I requested that they would do design according to specs I sent, they are refusing to do it, very suspicious of their real motives, to steal inventors ideas!

From the time of an initial contact, through the research and development of a new product idea, to the presentation of a client’s product sample, we try to maintain an open channel of communication, disclosing our services and fee upfront and securing our clients’ approval and authorization throughout the process.

As stated in your post, you submitted a patented idea to Davison. It bears noting that it was a design patent and not a utility patent. The significant distinction being that the design patent addresses only the ornamental features and not the structure and/or function of the idea. Davison is not a prototype manufacturer that creates a product sample based upon the client’s preconceived notions. Davison is a design and development firm whose goal is to create a product sample that is a cost-effective solution to the problem identified by the client. Davison didn't fulfill their contract

I contracted Davison to design & build a prototype for me. After promising me a "Brainstorming session" with designers at the onset, they refused all attempts I made to have the brainstorming session, refused to share any information on what they were doing, refused to provide budget a& timeline information on the work they were supposedly doing for me and instead went on to design a totally different product than I contracted them to do, refused to show that to me until they completed the packaging design for a company they planned to offer it to!

When finally showed their design, it wasn't even a design at all! It was a graphic picture of a product with a totally different name that did not even perform my ideas main function! Then tried to hit me up for more money. I did not approve of what they were trying to deliver and told them so by telephone, email and registered mail.

They told me they were arranging a conversation for me with their president Mr. Davison back in July but never did. Then had the nerve to try and offer me a coupon for a discount for additional services. I reminded them they still hadn't fulfilled their initial obligation and that I planned to turn the matter over to my attorney.

Now, after I tell their vice president that I want my money back or I'm handing it over to my attorney, I get this letter offering to stall yet once again for a phone call from the President, this time Frank Vescio. I was actually in the middle of preparing the timeline of my dealings with Davison & collecting evidence my attorney asked me to provide to him for the letter he is preparing for Davison to initiate a lawsuit for my money back, when I saw this posting.

Customer concerns upset everyone and our staff works very hard to troubleshoot them so communication errors are kept to a minimum. From the time of an initial contact, through the research and development of a new product idea, to the presentation of a client’s product sample, we try to maintain an open channel of communication, disclosing our services and fee upfront and securing our clients’ approval and authorization throughout the process.

Initially, it should be clarified that you entered a contract for design services in April 2016. You were offered multiple payment options, including an hourly rate, and chose a lump sum retainer. Services under the contract are not due to be performed until full payment of the retainer has been received. To date, you have not made full payment and no services are due. Despite not being obligated, Davison does begin the design process when 60% of the fee has been paid.

Unfortunately, your post mischaracterizes the scope of work that is to be performed. You claim that Davison was to build a prototype - this is a mischaracterization. Davison is not a prototype manufacturer that creates a product sample based upon the client’s preconceived notions. Davison is a design and development firm whose goal is to create a product sample that is a cost-effective solution to the problem identified by the client. The contract explicitly states that there may be modifications, sometimes significant, to the client’s proposed solution. Davison began its services and submitted a proposed design for your review. Would like to get my $795 back

Sure would like to know how I could get my $795 back. Scam artists that like to make people feel ***, part of their scam.

I am a firm believer that everything happens for a reason.

The reason I was scammed by Davison, was to teach me the lesson of checking businesses out before giving them my hard earned money.

I feel blessed that I was smart enough to check them out before giving them $14,000 for the next part of development.

I feel so sorry for the people with the horror stories, Davison taking their life's savings, paid $14,000 and no product ever produced, etc.. I do not understand how anyone working for Davison sleeps at night!!

Your post is defamatory. Your implication that Davison does not disclose its services and fees, and your allegation that no products are produced are simply false. It is suggested that you read pissedconsumer.com’s legal disclaimer concerning personal liability for posts. It should be made clear that you had been a client of Davison, and services were provided, nearly two and a half years ago. The lengthy period of time before posting your comments bears on the credibility of your position.

You first contacted Davison on 06/19/2014. The system utilized for electronic submissions makes it impossible for a person to submit an idea without first having two separate disclosures displayed in a printable and savable format, and the person electronically acknowledging the disclosures. You acknowledged, via an electronic signature, that you received and read the two disclosure statements. It is important to note that the disclosures are made BEFORE you entered any service contract and BEFORE you made any payment. Among the disclosures is the statement that “It is Davison’s normal practice to seek more than one contract in connection with a submitted idea.” The disclosure then provides a listing the various services and related fees. Further, this information is freely available on the company’s website.

Following your acknowledgment of the disclosures, you entered into an agreement for Pre-Development services which obligated Davison to compile research data related to your product idea. Davison completed the Pre-Development services on 07/28/2014. The Pre-Development Agreement states in relevant part (emphasis added);

“Section II B. Product Samples; Approvals. Client is responsible for obtaining a product sample and relevant information about the product in a professional format for presentation to a Licensee, at Client's sole expense. Davison, at its option, will offer to provide further development services, under a separate contract for a separate fee, to assist in obtaining or creating the sample and presentation material for the targeted Licensee. Client is aware that he or she is free to obtain such materials elsewhere or not to obtain them.”

Following the completion of the services under the Pre-Development Agreement, Davison provided a proposed agreement for further development work. This proposal is consistent with the disclosures and the terms of the Pre-Development Agreement. You did not engage these services which is your prerogative. The design and construction of a physical product sample is part of the additional services which you declined.

As stated, you were fully informed of all services and their related fees offered by Davison, BEFORE entering into any contract. It is simply not possible to be more upfront with clients about the services and fees that are offered. The services for which there existed a contract have been performed. No additional contracts have been entered and no additional payments have been received. It is misleading for you to allege you were not informed of the various services and their related fees or to complain that no product was produced when you declined those services.

Customer concerns upset everyone and our staff works hard to address them in a timely manner. You contacted Davison with an idea for a new product and entered into a Pre-Development Agreement for the completion of research related to your submitted idea. This research was completed and provided to you. Following this service, you completed a questionnaire in which you gave positive feedback. Davison has performed its services to your documented satisfaction; there is no basis for a refund.

In your post, you imply a deceptive motive in relying upon the written contracts. That is unfounded. Davison makes a continued effort to minimize any confusion over its fees and services. There is a full disclosure of all services and fees before any service contract is entered and before any payments are made. The contracts are simply written with no “fine print” provisions, and the staff maintains an open channel of communication throughout the process. To simply ignore the written terms, and rely on alleged verbal statements, would create the typically unending, and irresolvable, “he said – she said” scenario. The contracts state clearly, and fully, the scope of services to be provided. Reliance on the contract terms is not only prudent, but necessary, to avoid undue confusion.

You also demand the return of your prototype despite your prior acknowledgement that Davison has no obligation to retain or return any material that you may have provided. When you submitted your idea, you did so pursuant to a Confidentiality Agreement. The Agreement expressly states; “I will not send Davison materials or prototypes that I want returned because Davison will not return any materials submitted to it by me concerning my idea.” Further, the Pre-Development Agreement which you entered contains the following provision; “E. Client Materials. Davison is not responsible for the loss, maintenance or return of prototypes, drawings or any other materials submitted by Client to Davison.” You sent your materials to Davison after having entered these agreements. It is not reasonable to require Davison to serve as a permanent repository of any item any person decides to send. That is the express reason the above language is part of the Confidentiality Agreement and part of the service contracts. Despite having no contractual obligation, Davison will attempt to locate your prototype and, if it is located, will make arrangements for its return.

I paid over eleven thousand dollars , with agreement they would market and sell my product. Davidson company representative are rude, and uncaring. I feel horrible, I have four children and I wasted all of of my money for nothing . Please save yourself , invest your money .

Regrettably, the inflammatory and derogatory comments in your post are simply not supported by the facts. From the time of an initial contact, through the development process, to the presentation of a product sample, we try to maintain on open channel of communication, disclosing our fees and services in advance, providing simple and clear contracts, and securing our client’s authorization throughout the process. A review of your project file indicates Davison has performed its services with your express written approval and authorization. Further, the services have met with your documented approval.

You contacted Davison with an idea for a new product and entered into a Pre-Development Agreement for the completion of research related to your submitted idea. This research was completed and provided to you. Following the completion of this initial service, you entered into a second agreement for the design and construction of a product sample and presentation materials. Davison submitted a design of the product idea which you approved in writing. You also completed a questionnaire about the proposed design in which you provided positive feedback. In reliance on your approval, Davison constructed the product sample and created presentation materials in the form of an Executive Briefing, which contained an actual photograph of the constructed product sample. The Executive Briefing was provided to you and you authorized, in writing, the presentation of the product idea and completed a second questionnaire giving nothing but positive feedback. The presentation of the product idea was made to the corporation who, unfortunately, has not pursued the idea. Davison offered additional services which you have declined.

In your post, you make a number of mischaracterizations that should be clarified. First, you claim you received nothing. That is false. As the chronology above details, Davison has performed its services with your express written approval and authorizations and to your documented satisfaction. Next, you state the agreement was to “market and sell my product”. This is not accurate. Davison does not manufacture final goods and market or sell them to the general public. Davison designs and develop product ideas for presentation to corporations, who in turn may manufacture and market the product. Finally, you state you made an investment. To the extent this implies that you expected a guaranteed financial gain, you are mistaken. While that outcome is understandably desirable, the simple fact is; the product development process provides no guarantees of financial gain and Davison does not make such guarantees. The express terms of the contracts are explicit that Davison make no representation about the likelihood of financial gain. The contract which you entered contains the following provisions:

“Davison has made no representations concerning the likelihood that the Client will receive any financial gain from the development of the Idea.”
“Client acknowledges that…there is no way of knowing at this time if the targeted corporation will license, buy or pay royalties for the Idea once it has been developed. Client acknowledges that Davison has made no representations concerning the likelihood of licensing, marketing, royalty payments or profitability.”

Davidson Law suit with FTC

I am very pissed off at this company. I am a single mother who worked very hard to be able to give them $10,000 to invent the SPIN BRUSH.

They said they did a title search....another $600. Couldn't figure out how to make it so I have to send them a device, where they could make it. Then I got a phone call.. stating they could not make the product and refused to tell me why.

They pushed me hard on another version of the product... and got me to sign off on it. Within one year my product was selling in stores all over.. along with commercials and everything.

I wish that I could find out if their so called relationships with vendors was to steal ideas from poor people and get even more from rich people. Plus, the ftc sued them, I got a letter settlement for $200 .... do you think I even got that back????

No now we have the lawyers taking the money.... What kind of world do we live in!!!

When you first submitted your idea, it was done under an agreement of confidentiality. This was before any service contracts were entered or payments made. Davison has abided by its obligation of confidentiality with regard to your idea, as it adheres to this obligation for all of its clients. However, Davison can not account for similar, or the same, ideas that may be submitted by other clients, or that may be disclosed to the general public through other avenues. Davison is not aware, and simply can not be aware, of every idea for a new product that any person, anywhere, may conceive. It is not uncommon for multiple people to conceive of the same or a similar product, independently. Simply because a client may not find the product at their local store, or have not found it in a cursory internet search, does not mean the idea has not been previously developed or may subsequently be developed. Your complaint highlights a common misperception – specifically that no one other than you could have thought of your product idea. The simple truth is that often multiple people conceive of the same or similar ideas independently.

A solution to bedbugs

I don't know what tonettee matt trip was. But it was a little fishy that she calls me and then tells me about a meeting that she needs to attend and that she will call me in an hour.

Not cool. I have an idea that will put bedbugs on the extinction list. I was very excited in what i discover. In what I made that cost me a couple of dollars.

I have videos and pictures that it works.

On June 14, 2016, you submitted an idea for a new product through our website. Several attempts were made to contact your about the idea, though these attempts were unsuccessful. Your post confirms that there has been no discussion of the idea. Then on July 01, 2016, literally 17 days later, you post this complaint which makes thoroughly unsubstantiated, defamatory comments. We suggest that you read pissedconsumer.com’s legal disclaimer concerning personal liability for posts. Our staff of over 250 people and their families don’t deserve to be defamed by a poster.

As stated, you did submit an idea through the website. That submission was done under an agreement of confidentiality. In your post you make the thoroughly unsubstantiated, false, and defamatory claim that Davison stole your idea. There is simply no support for such an inflammatory allegation. Davison has abided by its obligation of confidentiality with regard to your idea, as it adheres to this obligation for all of its clients. However, Davison can not account for similar, or the same, ideas that may be submitted by other clients, or that may be disclosed to the general public through other avenues. Davison is not aware, and simply can not be aware, of every idea for a new product that any person, anywhere, may conceive. It is not uncommon for multiple people to conceive of the same or a similar product, independently. Simply because a client may not find the product at their local store, or have not found it in a cursory internet search, does not mean the idea has not been previously developed. Further, the timeline of events highlights the irrationality of your allegation. You submitted the idea on June 14th and posted your complaint seventeen days later. To believe that a physical product can be taken from an idea, through the design process, through manufacturing, packaging and distribution in seventeen days is simply irrational. The product development process is considerably more time intensive.

Scamed us out of money

In the summer and fall of 2014 my associate and I spent numerus phone conversations with the Vice President of New Products, Chad Murray, who assured us that Davidson Design and Development Inc. would make us a lot of money. Mr. Murray also, assured my associate and myself that his company would be more then adequate to take my product and have it on the market in a short period of time. It is now June of 2016 and they are no closer to that goal then it was 2 years ago. My product had already been patented, field tested and marketed, but I was still required to put money up front for them to do research and development. To this day, Davidson Design and Development Inc. has not done any research or development that I have any knowledge of. On December 3, 2014 I signed a contract with Davidson Design and Development Inc. and paid an additional $8.000.00. I was contacted on a WEEKLY basis and assured that a team of individuals were working on getting the product ready to present to a manufacturer and distributor. In February of 2015 I delivered to Mr. Murray a feeder to use to speed up the process that is valued over $500.00. I wasted over 500 hours on the phone with Mr. Murray and all I got in return was two inferior pictures, or what they call renditions. My time is worth $100.00 per hour. (I am now into this scam company for over $50,000.00) Then in November of 2015 I received the first rendition. It was inadequate to say the least. It had patent pending on it and to this day I have not received an adequate explanation why that was on a product that already had been patented. It indicates to me that they were going to try and steel my patent. I refused to sign such an inferior rendition and then six months latter another rendition was sent to me, which was worse than the first. I expressed my dissatisfaction with the whole process. I received the same run around or double talk that I had heard for two years. On May 17, 2016 I sent Mr. Murry an email that I put in writing what I wanted to continue. In short, either a set time line on father actions or my money back. (I still have the email I sent if needed) He contacted me twice to get me to talk to the President of New Products Frank Vescio. After spending another five hours in emails that I have kept to show how ridiculous the whole process was. Mr. Vesico called me on May 27, 2016 and all but threated me by saying he was going to do what he wanted to, no matter what I wanted. To this day all I can verify that Davidson Design and Development Inc. did was computer generate two pictures; I could have had done in 48 hours, for less that $100.00. This is differently not what I paid for and is not worth the money I paid this scam company.

I will make it simple I do not trust Davidson Design and Development Inc. to fulfill anything, I WANT ALL MY MONEY BACK.

Customer concerns upset everyone and our staff works very hard to troubleshoot them so communication errors are kept to a minimum. A brief summary of the work performed on your project is illustrative. You contacted Davison through its website. You were provided with, and acknowledged having received and read, two separate disclosures displayed in a printable and savable format. It is important to note that the disclosures are made BEFORE you entered any service contract or made any payment to Davison. The disclosures provide a listing of the various services and related fees as well as the historical licensing data. You then entered the initial pre-development contract which obligated Davison to compile research on U.S. Patents and products, which were similar to your idea. This research was completed and provided to you. Subsequently, you entered an Integrated Product Rendering and Presentation (IPRP) agreement for the design of a rendering of the product idea and creation of presentation material. Davison submitted a proposed design for your approval. You did not approve the initial design. Based upon your input, the project was re-designed and a second rendering was submitted for approval. Again, you did not approve the design. Davison’s Office of the President spoke with you to elicit further details in a continuing attempt to create an approved design. You ceased responding and have demanded a full refund. There is no basis to support a refund, nor support for the complaint. Based upon your expressed desire to terminate the relationship with Davison, further work on your project has been suspended, pending an agreement to move forward.

With regard to your specific complaints, you initially allege you were informed that you “would make a lot of money” and that the project would be “on the market in a short period of time”. Such claims are directly contradicted by the disclosures and explicit contract terms. The simple fact is; the product development process provides no guarantees of financial gain. Davison does not make such guarantees. Next, you allege that Davison did not perform the initial pre-development research. This statement is not only false, but illogical. The first service contract obligated Davison to compile research relevant to the submitted product idea. This research was conducted and the results provided to you in a Product Portfolio in October 2014. After completion of the initial services you entered the IPRP contract in March 2015. Had the initial research not been completed, it is not logical to think you would then enter the second service contract. Thirdly, you complain of having received only “two pictures”, implying you contracted for something different. As stated above, the IPRP contract was for a graphic rendering, i.e. a picture, illustrating the product idea and subsequent presentation material. Davison has submitted two separate renderings which have not met with your approval. The creation of the subsequent presentation material is dependent upon the approval of the design rendering. Finally, you claim the inclusion of the term “patent pending” on the rendering indicates Davison’s intention to claim ownership of the idea. This is false. The contracts entered explicitly states that they do not change legal title to the product idea. Also, as you point out in his complaint, you have already secured a patent. The inclusion of the term is appropriate when a client has filed a provisional patent application covering their idea. If you do not file an application covering any changes the final approved design may incorporate, that is your prerogative and the rendering will not include the term.

There is no factual basis to support your complaint and no basis for a refund. The derogatory comments, allegation of threats and exaggerated claims (ex. 500 hours on the phone) are pure vitriol, meant to inflame rather than inform. As stated above, you were fully informed of the services and fees BEFORE entering any contract. The pre-development service has been performed. The IPRP agreement provided a seven day revocation period in which it could have been cancelled and a full refund provided. That provision was not invoked, and Davison has made multiple good faith efforts to complete the services under the contract terms. Davison remains committed to your project and will consider any suggestions submitted in writing which are consistent with the contract terms.
